During the first portion of the two-hour class, I will review best practices and techniques for effectively monitoring and capturing both historic and real-time social media and web data of individuals. I will explain the benefits and challenges of social media monitoring for litigation, insurance law, criminal defense, jury selection and more.
I will also review the many uses of social media data, the ethical considerations when collecting this information and how best to review the data that is found.
During the second half of the class, Frances Crockett Carpenter will discuss how to effectively litigate social media evidence. She will review what to instruct your client at the first meeting regarding the pitfalls of social media, the end stages of using evidence gained from social media in your trial and all the in-betweens. She will also review court cases involving social media from various jurisdictions and how the court ruled in each.
